RE: Great Lakes Multiple Sclerosis
Walk a thou Event Approval
Dear Mayor and City Council
Members:
Jim Knopp and I met last week with
Jeff Bross, the representative Great Lakes Multiple Sclerosis
Walk a thon proposed and planned for Sunday May 4th.
We have reviewed the attached special event application. The
Yack Arena is being used as the base to begin and end the 3.2
mile walk. The route is downtown along the sidewalks. The
organization expects up to five hundred walkers over the course
of the event. Attached is their request and application. Details
of the route and rest areas are given on their attached maps and
diagrams.
The group will require a closure at
the entrance to Yack Arena Parking lot at Sycamore Street and at
Maple Street. Gary Ellison, DPW is aware of the barricades
needed and will arrange for those. I also contacted Dan Grant
and he indicated police reserves are available for crossing
assistance at the heavy volume intersections.
Please authorize approval for this
special event. Thank you.

The City Attorney has reviewed

RE: Addressing
Issue of Damage to Neighboring Properties from Contractors and
Property Owners
Dear Mayor and City Council:
The above referenced matter was
referred to my office for review and a report back. I have
reviewed this matter with the City's Engineer Department and
have also conducted a summary of neighboring communities to see
how this matter is handled. The neighboring cities generally
will contact the offending contractor to see if the matter can
be resolved and if it is not, then it results in a civil matter
between the property owner and the contractor.
A suggestion was made that the City
or contractor would be required to send a notice prior to
commencing work within the City to neighboring property owners
within a certain distance. However, it is my opinion that this
would create a lot of paperwork and checking by the City and in
the end would not provide any greater enforcement by the City in
the event of any property damage. However, I would recommend
that the City adopt an ordinance creating a municipal civil
infraction for civil trespass in those instances where a
contractor or property owner causes damage to neighboring
property and fails to rectify the situation. In addition, the
ordinance may provide for a lesser fine against the offender in
the event they would correct the situation with the neighbor or
pay any restitution when warranted.

In the best interest of the City, I
recommend that the park south of Ford Avenue be included with
the North side Lots. Therefore, the undersigned recommends the
acceptance of the proposal from Frank's Lawn Maintenance of
Trenton, Michigan for the south side lots in the amount of
$13,572.00 and J & R Landscaping of Wyandotte, Michigan for the
north side and park in the amount of $21,606.00 as the best bid
received meeting specifications.

RE: Updated Massage Ordinance
Dear Mayor DeSana and City Council

Enclosed please find a
proposed Ordinance to regulate massage establishments and
outcall massage services for a First Reading. I have had this
reviewed by the Chief of Police, the City Engineer and the City
Clerk. The purpose of the Ordinance is to update and replace our
current Ordinance and to regulate massage establishments and the
administration of massages at a location designated by the
customer.
The Ordinance requires
a permit for any masseuse and also requires any massage
establishment to obtain a license. The Ordinance prohibits lewd
acts and permits inspections of each massage business
establishment by the Police Department to verify that the
provisions of this Ordinance are fully complied with. Any
existing massage parlors may continue under their current
Ordinance and will be required to comply with this Ordinance
when their current City license expires.
