Please permit us to present an issue and proposal for the Mayor and Council regarding the safety and aesthetics of our property and newly built home at 524 Riverside Drive.

We moved into our new home on March 16, 2007. Shortly thereafter, on June 4, 2007, Wyandotte police weir chasing a drunk driver in a car northbound on 9th Street (Case Number 3367-07; Wyandotte Detective Scott Galeski). The fleeing individual failed to make the turn at the corner of 9th and Bondie and drove his vehicle through my front lawn and driveway causing property damage in excess of $2,000.00 and nearly collided with one of my automobiles parked in the driveway (see attached photos in Exhibit A). Thankfully, the incident occurred during the early morning hours of June 4, 2007, and not during the day when my six-year old daughter typically plays on the front lawn and driveway.

After speaking with the two neighbors directly beside our home, I discovered these types of incidents (not necessarily involving police chases) have occurred several times in the past at the same intersection on this property before it was sold and developed, particularly during the winter months when the roads are snow-covered (see statement of Paul and Renae Affholter in Exhibit B).

I would like to have permission and formal approval from the Mayor and city council to landscape at my own expense a portion of the border region of my property and easement facing the intersection in issue with a small gently-sloping berm or bank made from topsoil and covered on one side with 12"-24" natural decorative Michigan fieldstone, totaling approximately 36" high and 5 feet wide, following the street curb, as per drawing (Exhibit C).

The parcel of land directly adjacent and south of my property belongs to the city and has remained undeveloped for the purpose of access to the Ecorse River (Exhibit D). I would like permission to gently taper the proposed berm along the curve of the street curb extending 10 feet from my property line onto the empty access lot belonging to the city (see Exhibit D). This would in no significant way obstruct the city's access to the river, as the access lot is approximately 50 feet wide, in total. Should the city require temporary removal of the tapered end of the berm extending on to the city's access lot and/or easement, for whatever reason, it could easily and quickly be removed.








Steffin and Loretta Goodwin, my neighbors to the south (606 9th Street) whose property also abuts the city's access lot, have informed me that 13 years ago they agreed with the city to maintain the city's access lot. After we moved in, the Goodwins and I agreed to each be responsible to maintain our half of the city's access lot. We continue to regularly do so at our own expense. In addition to our other neighbors, Paul and Renae Affholter, Mr. and Mrs. Goodwin have also expressed their approval and support for the proposed berm (Exhibits B and E). I have also spoken with the City Inspectors and they have expressed the feasibility of my proposal. We believe a barrier in the proposed area is important to our safety and the protection of our property. We also believe the barrier, as proposed, would add to the aesthetics of the neighborhood. Would the Mayor and Council please grant us formal permission to proceed with this proposal?

Honorable Mayor and Council,

I object to the fact that you took it upon yourselves to put forth a resolution based upon a petition signed by a “group” of people reflecting their opinion of a national policy.

I you feel strongly that it is proper I suggest you have a special election whereby you are able to state the number of people who voted for and against your resolution.

I cannot recall seeing party affiliation on the local election ballots and certainly do not expect members to push party policies at our local level.

In answer to the resolution dated September 11, 2007, we have addressed the tree at 622 Riverbank with our professional tree trimming crew. The crew was able to clear the area around the power lines but due to the size of this tree any additional clearing will require a crane and extensive manpower, beyond the scope of our tree trimming crew. We were also able to discuss this situation with the property owner.

Also, I recommend the purchase agreement be amended to include the credit to the Zehel's for the porches.

Also, a price was received from Carefree Lawn Center and Freeport Landscaping Stone & Supply, Brownstown, Michigan for 250 yards of top soil at a price of $12.00 per c.y. DPS to get topsoil from the most convenient location.

The attached Resolution will authorize the undersigned to accept the proposal of Huron Sod Farms, Inc., Romulus, Michigan in the amount of $2,600.00 to be paid from account 499-200-851-519. Also, purchase topsoil from either Carefree Lawn Center or Freeport Landscaping Stone & Supply for $12.00/c.y.

All labor will be performed by the Department of Public Service.

SECTION VI - CITY TAX RATES
Preliminary City Tax Rates were adopted on July 23, 2007, after the required notices were filed and Public Hearings held. The Rates were calculated in accordance with Michigan Compiled Law Section 211.34E and 211.34D. The calculated City Tax Rates are the minimum required to defray operating expenses for the fiscal year October 1, 2007, through September 30, 2008. The Rates are as follows:

RESOLVED by the City Council that Council hereby CONCURS in the recommendation of the City Engineer and Director of Administrative and Financial Services as it pertains to File # 4422-2007 Sanitary Sewer Repair to accept the bid of Troelsen Excavating Company of Troy, Michigan in the amount of $282,440.00 from account #590-200-926-310 with the balance of said account to be carried forward to the 2007-2008 Budget year; AND BE IT RESOLVED that all bid bonds be returned to the unsuccessful bidders by the City Clerk and all bid checks be returned to the unsuccessful bidders by the City Treasurer; and that the Mayor and City Clerk are hereby authorized to execute the necessary documents to perform said work.

Look, are hereby authorized to sign said documents; and further that the City Engineer is directed to DEMOLISH same upon completion of the Wyandotte Historical Commission inspection of the home as it pertains to the preservation of historical and cultural items for the City of Wyandotte.

RESOLVED by the City Council that Council hereby CONCURS in the recommendation of the City Engineer regarding the moving of the home from 110 Spruce to 245 Mulberry; AND BE IT FURTHER RESOLVED that Council CONCURS with the Addendum to the Purchase Agreement between the City of Wyandotte and John and Casandra Zehel and Council hereby authorizes the Mayor and City Clerk to execute the necessary documents; AND BE IT RESOLVED that Council accepts the bid of Fine Finishings of South Rockwood, Michigan in the amount of $112,554.00 which deducts the work for both porches to be paid from account # 492-200-850-519 for File # 4418-Moving House from 110 Spruce to 245 Mulberry subject to City closing on the purchase and sales agreement between the City and John and Casandra Zehel; AND BE IT FURTHER RESOLVED that all bid bonds be returned to the unsuccessful bidders by the City Clerk and all bid checks be returned to the unsuccessful bidders by the City Treasurer; AND FURTHER that the Mayor and City Clerk are hereby authorized to execute the contract between the City of Wyandotte and Fine Finishings.
