Topic: Ash Tree on City Property in alleyway of 335 6th St.
Dear Sirs:
Please direct this letter to the proper department or personal to
resolve this problem. I am the property owner of 335 6th Street
Wyandotte, Michigan. I have made numerous calls to various
departments to cut down the ash tree that is on the easement in
the ally way of 335 6th St. but to no avail.
Finally on 8-9-07, I took it on myself to rent a 60 ft. power lift
for over $600.00 to cut down the tree in the alley way. Upon
starting to trim the tree Jerry Kupser from the electrical
department came by and stopped the job. Note: I am a retired
tradesman with experience operating power equipment and have cut
down many trees including one over 4 ft. in diameter 8 ft. from a
house.
This has cost me over $ 600.00 for the rental, which should be the
cities responsibility. I am done worrying about these trees. I now
consider it the cities responsibility to worry about these trees.
I will not take any responsibility for the cities trees.
1. The state has given the city money to cut down diseased ash
trees.
2. 3/4 of the tree is past my property line in the alley way
3. There is a tree (not ash) in the same ally way at 637 Highland
300ft. from the one on 6th St. that the city has marked to take
down. That tree is 1/4 the size of the ash tree and not near as
far in the alleyway.
4. There are 3 separate trees at 6th St. grouped together as one.
The one tree that is definitely on my property is healthy with
leaves on it. The others are dieing with branches above the power
transmission lines.
5. These other trees are in the alleyway for the cities easement
of the power lines. These trees are affected by the ash bore and
have brittle branches, which could easily break and fall on the
power transmission lines.
6. I am done trying to take care of the cities responsibly. I will
do every thing to keep the tree on my property healthy but I could
care otherwise what happens to the trees on the cities easement.
7. I have already spent over $600.00 for nothing to show for and
not going to spend another penny except to protect my legal
rights.
8. While starting to trim these trees Jerry Kupser was able to get
there in minutes, yet after the incident I have made numerous
phone calls to his office to discuss the problem but to no avail.
Once again I employ the city to remove these trees before they
injure someone or take down the telephone, cable and power
transmission lines.

Christina Hill, 435 Cedar, regarding park on Cedar Street, Frostic
Park, has rocks on top of asphalt. Children are throwing rocks and
children are falling on the rocks. Please remove rocks due to
injuries to her child and others.
Jim Knopp: rocks were base for old work; they will be corrected
within two weeks.

Enclosed for your review and consideration is an application from
Mr. Bryan Sollors of Lions, Tigers and Beers, 2930 Van Alstyne,
for a temporary permit for a Class C outdoor services permit for
September 21 and 22, 2007.
The above will be utilized in conjunction with the Southern Wayne
County Regional Chamber and moving the bull statue owned by
Merrill Lynch from 3217 Biddle to their new location Oak and
Biddle Avenue.
Said application has been approved by Police Chief Grant and
requires approval by your honorable body.
In addition to the above, the undersigned hereby requests your
honorable body approve a generic resolution authorizing the City
Clerk to sign any and all applications for temporary outdoor
services as required by the Michigan Liquor Control Commission,
when approved by the Chief of Police and when the proper hold
harmless agreements and insurance requirements are on file in the
Clerk's Office.
Said procedures will expedite the issuance of same when time is of
the essence as well as enhance Council's efforts to be business
friendly.

Dear Mayor DeSana and City Council Members:
In response to the request of Robert Wery, 806 Biddle Avenue, My
Place Bar and Grill, to amend the Arcade Ordinance the following
applies. The Wyandotte Zoning Ordinance, Section 1401.c., Business
B-2 Zoning, lists an amusement arcade as a special use. A special
use requires review and approval of a site plan at a public
hearing by the Planning Commission. Amusement Arcades are reviewed
in accordance with the following four (4) criteria:
Pool Halls and Amusement Arcades
1. Facilities shall be subject to all codes and ordinances
governing such establishments.
2. Locations for any such establishment shall be confined to major
thoroughfares and shall have the entrance to both the business and
parking area for such establishment on the thoroughfare. Access
from a side residential street or alley shall be prohibited.
3. Locations for any such facility shall be no closer than five
hundred (500) feet to the property line of any elementary,
intermediate or high school.
4. No such business shall be located within five hundred (500)
feet of the property line of a similar business.
Also an arcade has the following parking requirements:
Two (2) for each game table and one (1) for each amusement device,
or one (1) for each one hundred (100) square feet of usable floor
area in the game room, whichever is greater.
VS the Current parking requirements which are:
One (1) for each seventy five (75) square feet of usable floor
area; plus one (1) for each employee. In those instances where
patrons are served without seating, one (1) space for each twenty
(20) square feet of standing room floor area in addition to the
above requirements shall be provided.
Changes to the definition of what constitutes an arcade per
Section 3-126 will affect the above sections of the Zoning
Ordinance
Currently, an amusement arcade is an establishment with eight (8)
or more mechanical amusement devices. Mr. Wery has indicated he
has 14 amusement devices placing him in violation of the Zoning
Ordinance. If the Ordinance were changed to modify the definition
of an amusement arcade as "an establishment with fifteen (15) or
more mechanical amusement devices", Mr. Wery would not require
special approval from the Planning Commission.
Changing the Zoning Ordinance may create a parking problem since
additional parking would not be required until a fifteenth machine
is utilized. Further, it would allow other establishments to place
more amusement devices in their buildings without meeting the
Special Use Requirements. Therefore, we recommend no change to the
Zoning Ordinance.
If the applicant is successful in obtaining special use approval,
then the city at that time could consider whether it would be
necessary to amend Section 3-151 of the General Code of Ordinances
(Licensing of an Arcade) for those establishments that have an
approved liquor license.

Dear Mayor DeSana and Council Members:
The Wyandotte Recreation Department has had an excellent
relationship with S & D Field Services of Westland, Michigan, as a
provider and installer of playground equipment for over seven
years.
During this time, they have been awarded all bid contracts for
playground equipment and renovations except for the 2005-2006
Playground Project on which they did not bid. The quality of work
done on the 2005-2006 project was of such inferior quality that
the contract was terminated and S & D Field Services was hired to
correct and finish the project.
In 2005, S & D gave a preliminary quote on the proposed new
playground to be located at 9th and Vinewood. They have just
reaffirmed that quote with a slight percentage increase on
materials only that matches the increase on playground equipment
nationwide.
The Superintendent of Recreation recommends that your Honorable
Body accept the quote from S & D Fields Services of Westland,
Michigan in the amount of $47,811.74 for the playground equipment
at the 9th & Vinewood Playground in the best interest of the City
of Wyandotte.
I will be present at the Council Meeting to answer your questions
on this recommendation.

Dear Mayor and Council,
Enclosed is the application of ADB Properties, LLC, for the
issuance of an Obsolete Property Rehabilitation Exemption
Certificate (the "Certificate") for the property at 204 Oak
Street, Wyandotte, Michigan.
Also enclosed is a proposed resolution setting a hearing date of
October 1, 2007, on the issuance of a Certificate. Prior to the
hearing, the Obsolete Property Rehabilitation Review Committee
will submit to the Mayor and Council a recommendation regarding
the length of the Certificate (from 1-12 years) and any associated
conditions. Further, the applicant will make a presentation during
the hearing indicating the planned interior and exterior
improvements to the building and property.

RE: Proposed Entryway Sign #2 at Southeast Corner of Eureka and
Fort Street
Dear Mayor and Council,
Enclosed for your information is a proposal from Sarnacki &
Associates Architects, Inc. for architectural services for the
design and document preparation of a second "Welcome to Wyandotte"
sign. The sign will be almost identical in design, materials and
lettering to the sign located at the northeast corner of Eureka
and Fort Street (in front of Walgreen's). The overall dimensions
and setbacks of the sign will be modified to fit within the
easement area provided by the property owner.
Funds for architectural services will be provided from the
Wyandotte Brownfield Redevelopment Authority's budget for Project
Development & Environmental Services. Once the sign design is
completed, it will be included as an exhibit to an Easement
Agreement that will be presented to the Mayor and Council for
approval.
Since the proposal for services doesn't exceed $2,500, approval by
the Mayor and Council isn't required. The undersigned recommend
that this communication and the attached proposal be received and
placed on file.

THE CITY OF WYANDOTTE ORDAINS:
Section 1. Adoption of Section 25-76.4, entitled "Giving False
Information to a Police Officer".
Section 25-76.4. Giving False Information to a Police Officer;
Penalty
(a) It shall be unlawful for any person to report or cause to be
reported to any police agency any information concerning the
commission of any offense or other incident that would require
police action when (1) that person knows that no such offense or
other incident has occurred; or (2) the person knows the
information to be false or that he has no such information.
(b) It shall be unlawful for any person arrested for or charged
with a crime or who was issued a municipal civil infraction or a
civil infraction by a police officer or other authorized City
Employee to deliberately give a false name or false addresses to
the police officer or to any employee of the court. "False name"
shall be defined as the giving by a person of any name other than
his or her own legal name.
(c) Any person convicted of violating this ordinance is guilty of
a misdemeanor and is subject to a fine not exceeding Five Hundred
($500.00) Dollars and/or Ninety (90) days in jail.
Section 2. Severability.
All ordinances or parts of ordinances in conflict herewith are
hereby repealed only to the extent necessary to give this
ordinance full force and effect.
Section 3. Effective date.
This Ordinance shall take effect fifteen (15) days from the date
of its passage by the Wyandotte City Council and the Ordinance or
its summary shall be published in a newspaper generally circulated
in the City of Wyandotte within ten (10) days after adoption. A
copy of this Ordinance may be inspected or obtained at the City of
Wyandotte Clerk's Office, 3131 Biddle Avenue, Wyandotte, Michigan.
On the question, "SHALL THIS ORDINANCE NOW PASS?", the following
vote was recorded:

PROPERTY REHABILITATON EXEMPTION CERTIFICATE IN THE CITY OF
WYANDOTTE

RESOLUTION by Councilperson Joseph Peterson
RESOLVED by the City Council that:
WHEREAS, Pursuant to Public Act 146 of 2000, as amended, the City
of Wyandotte has established Obsolete Property Rehabilitation
District No. 7 covering the property commonly known as 204 Oak
Street; AND
WHEREAS, ADB Properties, LLC, who is the property owner of said
realty located within said District, has applied for an Obsolete
Property Rehabilitation Exemption Certificate under provisions of
Michigan Public Act 146 of 2000, as amended; AND
WHEREAS, Michigan Public Act 146 of 2000, as amended, provides
that before action upon an application for an Obsolete Property
Rehabilitation Exemption Certificate, the City Council shall
afford the applicant, the Assessor and a representative of the
affected taxing units an opportunity for a hearing.
NOW, THEREFORE BE IT RESOLVED:
1. That the application of ADB Properties, LLC, for an Obsolete
Property Rehabilitation Exemption Certificate dated August 28,
2007, shall remain on file in the office of the City Clerk where
it was received on August 28, 2007.
2. That the application of ADB Properties was completed on August
28, 2007, when the elevations and color renderings for the project
were received in compliance with the City's OPRE Review Policy.
3. That the City Council shall meet in the City Council Chambers,
Wyandotte City Hall, 3131 Biddle Avenue, Wyandotte, Michigan, on
October 1, 2007, at 7:00 p.m., Local Time, or as soon thereafter
as may be heard, and shall provide the City Assessor, the
applicant, a representative of each of the taxing units, and any
other taxpayer or resident of the City of Wyandotte an opportunity
to be heard on the question of said application for an Obsolete
Property Rehabilitation Exemption Certificate with regards to
operations within Wyandotte Obsolete Property Rehabilitation
District No. 7.
4. That the City Clerk immediately inform, by certified letter,
the City Assessor, the applicant, and the legislative body of each
taxing unit which levies ad valorem taxes in the City of Wyandotte
as follows:
a. That the City of Wyandotte has established Wyandotte Obsolete
Property Rehabilitation District No. 7 and has now received and
will consider an application for an Obsolete Property
Rehabilitation Exemption Certificate within said District No. 7.
b. That the City Council shall meet on October 1, 2007, in the
City Council Chambers, Wyandotte City Ball, 3131 Biddle Avenue,
Wyandotte, Michigan, at 7:00 p.m., Local Time, or as soon
thereafter as may be heard to afford the City Assessor, the

At a regular session of the City Council of the City of Wyandotte
WHEREAS, the Council has received a communication from the
Community Development Director and City Engineer dated September
4, 2007, regarding a proposal for architectural services from
Sarnacki & Associates Architects, Inc. Sarnacki will prepare a
sign design and construction documents for a second "Welcome to
Wyandotte" sign to be located at the southeast corner of Eureka
and Fort Street.
WHEREAS, the sign design will be almost identical in design,
materials and lettering to the existing sign at the northeast
corner of Eureka and Fort Street. The overall dimensions and
setbacks of the sign will be modified to fit within the easement
area provided by the property owner.
WHEREAS, the final design will be included as an exhibit to an
Easement Agreement that will be presented to the Mayor and Council
for approval at a later date.
NOW, THEREFORE, BE IT RESOLVED THAT the communication from the
Community Development Director and City Engineer is received and
placed on file.

RESOLVED by the City Council that:
WHEREAS, Pursuant to Public Act 146 of 2000, as amended, the City
of Wyandotte has established Obsolete Property Rehabilitation
District No. 8 covering the property commonly-known as 1 St.
Johns; AND
WHEREAS, LTW Investments, LLC, who has a purchase agreement with
the property owner of said realty located within said District,
has applied for an Obsolete Property Rehabilitation Exemption
Certificate under provisions of Michigan Public Act 146 of 2000,
as amended; AND
WHEREAS, Michigan Public Act 146 of 2000, as amended, provides
that before action upon an application for an Obsolete Property
Rehabilitation Exemption Certificate, the City Council shall
afford the applicant, the Assessor and a representative of the
affected taxing units an opportunity for a hearing.
NOW, THEREFORE BE IT RESOLVED:
1. That the application of LTW Investments, for an Obsolete
Property Rehabilitation Exemption Certificate dated June 14, 2007,
shall remain on file in the office of the City Clerk where it was
received on June 14, 2007.
2. That the application of LTW Investments, was completed on
August 30, 2007, when the elevations and color renderings for the
project were received in compliance with the City's OPRE Review
Policy.
3. That the City Council shall meet in the City Council Chambers,
Wyandotte City Hall, 3131 Biddle Avenue, Wyandotte, Michigan, on
October 1, 2007, at 7:00 p.m., Local Time, or as soon thereafter
as may be heard, and shall provide the City Assessor, the
applicant, a representative of each of the taxing units, and any
other taxpayer or resident of the City of Wyandotte an opportunity
to be heard on the question of said application for an Obsolete
Property Rehabilitation Exemption Certificate with regards to
operations within Wyandotte Obsolete Property Rehabilitation
District No. 8.
4. That the City Clerk immediately inform, by certified letter,
the City Assessor, the applicant, and the legislative body of each
taxing unit which levies ad valorem taxes in the City of Wyandotte
as follows:

At a regular session of the City Council of the City of Wyandotte
RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYANDOTTE
WHEREAS, this Council by resolution has deemed it advisable and
necessary for the health, welfare, comfort and safety of the
people of the City of Wyandotte, to vacate a portion of the public
alley along the east property line of 1229 Poplar Street in the
City of Wyandotte, County of Wayne, State of Michigan, as a public
alley, more particularly described as:
The fifteen (15) foot wide public alley abutting the east property
lines of Lot 55 of the Lawrence Sub. of lot 8 and south 2.50 acres
of lot 7 of Frl. Sec 29 in T.3S.R.11.E. Ecorse (Now City of
Wyandotte). Wayne Co., Michigan as recorded in Liber 18, Page 20
WHEREAS, due notice has been given of the hearing of objections to
said vacation; and
WHEREAS, said hearing having taken place in accordance with such
notice, and no objections having been offered, and this Council
still being of the opinion that said vacation is advisable; now,
therefore,
BE IT RESOLVED that the above described alley shall be and the
same is hereby declared VACATED as a public alley, reserving to
the City of Wyandotte, a Municipal Corporation of the State of
Michigan, its successors and assigns forever and in perpetuity
from the date hereof, an easement on, over, under, across, and
within the fifteen (15) foot right-of-way of the above described
alley for the purpose of constructing, operating, maintaining and
repairing existing and future public utilities, sewers and drains,
and that said City of Wyandotte, its contractors, employees,
agents successors, assigns and lessees shall at all times have
free ingress to and egress from said alley right-of-way, to
construct, operate, maintain and repair said existing and future
utility lines of every nature, and sewers and drains.
BE IT FURTHER RESOLVED that there is hereby reserved to Ameritech,
its successors and assigns, an easement on, over, under, across
and within said fifteen (15) foot wide right-of-way for the
purpose of constructing, erecting, operating, maintaining, and
repairing its existing and future telephone communication system
consisting of poles, lines, wires, cables and apparatus; and that
said Ameritech, its contractors, employees, agents, successors and
assigns shall at all times have full ingress to and egress from
said fifteen (15) foot wide right-of-way for said purpose.
BE IT FURTHER RESOLVED that no structures, or any article or thing
whatsoever shall be constructed or maintained on, over, under,
across, or within the fifteen (15) foot right-of-way of the above
described alley except the erection of fences by the abutting
property owners and that in the exercise of the easement and
ingress and egress rights heretofore reserved herein said City of
Wyandotte shall not be liable for any injury or damage to, or
disturbance of, nor shall it have any duty to pay for or replace,
any animate or inanimate improvement on, over, under, across, or
within said fifteen (15) foot right-of-way.
