Dear Mayor and Council Members:
We have noted with interest the recent sale of One Perry Place and
we look forward to having a new business on the waterfront.
We also have noted that the new owners of this property have made
a request to the City of Wyandotte that we "assist" them in the
demolition of the concrete block buildings near the street. As
taxpayers in this city, we oppose such action. The change in
ownership was a private matter between two individuals (or
corporations) and we are certain that they were and are in
business to make a profit. The cost of any change in the
buildings, or the site, should be borne by the business. If our
house needed a new roof, would the City of Wyandotte assist us? We
believe not.
As our elected representatives, please vote against granting this
request.

Mayor James R. DeSana and City Councilmembers:
We would are in the process of renovating our building located at
269 Oak Street and would like to add some outside improvements.
We would like to take out the grass patch on the Third Street side
of the building and replace it with paving bricks similar to our
neighborhood on our Oak Street side and comparable to the ones
that the City has used on Biddle in front of City Hall.
Also, in front of the building on the Oak Street side we would
like to put planter boxes either made of landscape brinks or raise
them with squared off curbs such as the ones that line the curb in
front of City Hall.

willingness to help and are open to suggestions.

Pool Building.
The Recreation Commission is scheduled to meet on Wednesday,
August 22, 2007, for their regular monthly meeting. Therefore, I
am requesting an extension of two weeks until August 27, 2007 to
answer this Council Resolution.

The undersigned recommends extending the contract of NuCore Group,
Inc., of Toledo, Ohio to power wash and paint additional guardrail
and posts; replace approximately 700 lf of wood and replace two
(2) wooden ramps with colored concrete all at Bishop Park. The
same terms and conditions will apply as per their current contract
with the City. The additional work will be approximately
$26,220.00. This work is a requested expenditure within the TIFA
Consolidated 2007-2008 Budget.

Dear Mayor DeSana and City Council Members:
At the July 30, 2007, City Council Meeting, Council referred to
the undersigned a communication from Joseph and Joanne Cuva
regarding the installation of a three (3) foot vinyl fence in the
City Right-of-Way at 514 Oak, Wyandotte. To accomplish this, the
attached Grant of License and Hold Harmless Agreement would need
to be executed between the City of Wyandotte and Joseph and Joanne
Cuva the property owners. This Grant of License and Hold Harmless
Agreement have been reviewed by the Department of Legal Affairs
and approved.
The proposed Resolution authorizes the Mayor and City Clerk sign
said Agreement. Further, Mr. and Mrs. Cuva should be required to
pay the recording fee of $24.00 and that the Department of Legal
Affairs record same.

Dear Mayor DeSana and City Council Members:
Attached please find a letter from Mark Havlicsek, successful
proposal maker on the above captioned property for the
construction of a new single family dwelling. Mr. Havlicsek's
communication indicates that he is unable to proceed with the
purchase of the property due to the bad economy and his financial
institution decision to tighten up their measures on builders who
borrow money to build new homes. Further, Mr. Havlicsek has
requested that his deposit in the amount of $3,000 be returned to
him.
If you concur with Mr. Havlicsek's request the attached resolution
will authorize the Mayor and City Clerk to execute a Release of
Purchase Agreement, return of the deposit in the amount of
$3,000.00 provided Mr. Havlicsek executes a Release of Purchase
Agreement and directs the City Engineer to re-bid the property.

Jaycees to utilize the properties at 2050-2070 Biddle/86 Spruce as
their 2007 Haunted House.
If approved, the Jaycees would have to comply with Section 411,
Special Amusement Buildings, of the 2003 Michigan Building Code.
This Section requires, among other items, an automatic sprinkler
system, fire alarm system and emergency lighting. The Fire
Department and Plumbing Inspector should be consulted on these
items.
Also, it is recommended that the Wyandotte Jaycees and the City of
Wyandotte execute the attached Permit.

$14,500.00, pursuant to there proposal to construct a two (2)

backflow prevention system and emergency escape and rescue opening
per the 2003 Michigan Residential Code and attached garage. The

Dear Mayor DeSana and City Council Members:
In October 2006, the City of Wyandotte received a Quit Claim Deed
from Wayne County Treasurer deeding the property at 1605 Ford
Avenue to the City of Wyandotte for tax foreclosure. The City paid
Wayne County $5,662.47 and also paid the 2006 taxes on the
property. The previous owner, David Benedict is requesting the
City Quit Claim the City's interest in the property back to him.
It is the recommendation of the undersigned with concurrence with
the City Attorney to relinquish the City's interest in this
property for the amount of $7,800.00. This amount will cover all
costs incurred by the City of Wyandotte.
If this meets with your approval, I recommend that the Department
of Legal Affairs be directed to prepare the necessary documents
and the Mayor and Clerk be authorized to execute same.

Wyandotte's share. The funds are budgeted within the Major Street
Fund.

CITY OF WYANDOTTE RESOLUTION
At a regular meeting of the Wyandotte City Council ("Council")
called to order by The Honorable James R. DeSana, on August 6,
2007, the following resolution was offered:
Moved by Councilman Patrick J. Sutka
Supported by Councilman Johnny A. Kolakowski
WHEREAS, the Council has previously adopted a resolution to
participate in an exploration of the feasibility of forming a
consolidated fire department known as the Downriver Fire Authority
("DFA"), and
WHEREAS, the feasibility depends largely on whether a labor
agreement can be reached which will be acceptable to the unions of
all the cities, and which makes economic sense for each
participating City, and
WHEREAS, the fire fighters have expressed a firm conviction that
they cannot proceed with negotiations unless they have positive
assurance that they will not lose any rights or benefits in the
event that they become employees of the Downriver Fire Authority,
and
WHEREAS, the City of Wyandotte has collectively bargained a labor
agreement that 1) provides for a defined contribution pension plan
for all employees hired after October 1, 2000 and 2) does not
contain any minimum manning or staffing requirements, and
WHEREAS, the Interim Board of Directors of the DFA has approved an
amendment to its Articles of Incorporation to provide the needed
assurance to the fire fighters, and
WHEREAS, said amendment requires ratification by each of the
participating cities to be of legal force and effect, and
WHEREAS, the Council finds it to be in the interests of the
citizens of the City of Wyandotte to make possible the
continuation of the feasibility study by ratifying the action of
the Interim Board of the DFA; and
NOW, THEREFORE, BE IT RESOLVED that the Council hereby concurs
with the action taken by the Interim Board of the DFA on June 28,
to amend Article XV of its Articles of Incorporation as shown by
the following language, with changes in bold face type and
italics:
ARTICLE XV
PRESERVATIONS OF EMPLOYEE RIGHTS AND BENEFITS:
Subject to the Willis and conditions provided in Section 10 of Act
57, the Authority may employ such personnel and employees as it
may consider desirable and may retain from time to time the
services of attorneys, accountants and other consultants as the
Authority considers necessary to carry out the purpose of the
Authority.
To the extent which is feasible the employees of each of the
Cities whose duties are transferred to the Authority shall be
given comparable positions of employment with the emergency
service established by the Authority, and shall maintain their
seniority status and all benefit rights of the position held with
the City emergency service before such transfer, subject to the
exceptions and provisions of Section 10 of Act 57. All employees
transferred from employment with a specific City to employment
with the Authority shall be grandfathered under the pension
program in effect by their City on the effective day of the
transfer. All new employees hired by the Authority, after the
effective date of the transfer, shall be covered by a defined
contribution pension plan, the elements of which shall be
negotiated with the collective bargaining representative of the
Authority's employees. The Authority shall have all of the powers
provided by Section 10 of Act 57, and be subject to all of the
provisions, restrictions and limitations therein with respect to
employment.
Except as described in this Paragraph, any and all rights which
employees have under Michigan law as employees of cities be, and
the same are hereby, PRESERVED while serving as employees of the
Authority, including, but not necessarily limited to, rights under
Act 312 of 1969 and Act 336 of 1947. However, no minimum manpower
or staffing requirements shall be collectively bargained by the
Authority and its employee's representative or ordered by an
arbitrator acting under the provisions of Act 312 of 1969 or these
Articles of Incorporation.
NOW THEREFORE, BE IT FURTHER RESOLVED that prior to the
commencement of actual negotiations the Interim Board of Directors
hire legal counsel and develop a budget for legal services, with
each participating City paying a pro-rata share based upon an
objective standard adopted by the Interim Board, such population
or taxable valuation-tax base.

the Wyandotte Jaycees to use the properties at 2050-2070 Biddle/86
Spruce, Wyandotte provided all requirements of the Permit are met.
AND BE IT FURTHER RESOLVED that before opening said Haunted House
the Fire Department, Building Inspector and Plumbing Inspector
shall inspect and approve said Haunted House for compliance with
all City of Wyandotte Codes.

recommendation of the City Engineer and City Assessor dated July
31, 2007, regarding the Former 2220-8th Street, Parcel 3; AND BE
IT FURTHER RESOLVED that Council accepts the offer from Ciro and
Barbara Biundo, dated July 17, 2007, in the amount of $14,500.00
to construct a single family 2 story home consisting of 1,600
square feet, 1st floor exterior to be brick attached garage and
full basement with backflow prevention system and emergency escape
and rescue opening per the 2003 Michigan Residential Code; AND
FUTHER that the Mayor and City Clerk are hereby authorized to
execute the necessary documents subject to the approval of the
Department of Legal Affairs.

RESOLVED by the City Council that
WHEREAS, the City of Wyandotte believes quality roads are a vital
part of any community; AND
WHEREAS, certain improvements are necessary to North Line Road
(also known as Ford Avenue) to increase traffic safety and to
encourage economic development; AND
WHEREAS, County of Wayne has committed to resurfacing the Road in
an area generally described as North Line Road (also known as Ford
Avenue) from Fort (M-85) to Jefferson, W., and the CITY OF
WYANDOTTE will assist financially in the resurfacing of the road;
AND
WHEREAS, the City of Wyandotte will provided payment to the County
of Wayne in the amount of $162,075.00, from Act 51 major street
funds (as found in Exhibit A to the Agreement, which will be
adjusted to reflect final costs) based on the total estimated
costs of the project; AND
WHEREAS, the City of Wyandotte will provide a "Working Capital
Advance" equal to $81,038 upon execution of this Agreement, as 50%
of the CITY's participation.
NOW, THEREFORE BE IT RESOLVED, that the Wyandotte City Council
does hereby approve the proposed Agreement between City of
Wyandotte and County of Wayne for the resurfacing of North Line
Road (also known as Ford Avenue) from Fort (M-85) to Jefferson W.;
AND
BE IT FURTHER RESOLVED, that the Mayor and City Clerk are
authorized to execute the Agreement on behalf of the City of
Wyandotte.
