Re: Renewable Energy

Dear Mayor,

Vision with a purpose cultivates innovative technologies solving today's energy demands. It's all about identifying a need and solving a problem. Kulick Enterprises worked on a portable energy system for the military's mobile medical units. It was that project which initiated the design of CRESIT, an energy-saving system for residential and commercial applications.

Governor Granholm's 21st Century Energy Plan will require all power suppliers to obtain 10% of their power from renewable resources by the year 2015. According to energy policy-related study, investments in energy efficiency programs will create up to 19,000 additional jobs and increase the Gross State Product by as much as 1.6 billion dollars.

I would like to introduce a program for the local communities to participate in that would give them the leading edge. I am asking cities to consider offering a $2,000.00 property tax incentive of $500.00 per year for four years. This is the cost an average homeowner would have to spend in order to finance a renewable energy system. That figure is based on a four year loan, at seven percent interest.

There is currently a 30% federal tax credit in place which cannot exceed $2000.00 for solar. There is also a $2000.00 federal tax credit for water heating as long as 50% of the energy derives from the sun. There is no financing in place, nor are there any incentives for wind energy. Renewable energy has multiple benefits. Over the long term it helps the environment, creates jobs, boosts the economy, and promotes real estate growth.

DTE Energy is already offering a renewable energy option, under a new voluntary program called GreenCurrents. This gives customers the option to purchase blocks of renewable energy.

I would like the opportunity to meet with you and your council members to explain how each individual city would benefit by introducing this program. I look forward to hearing from you.

Dear Honorable Mayor and City Council Members;

On behalf of Mr. Fred May, Owner and CEO of Mercury Manufacturing Company, I. wish to request that the City of Wyandotte consider selling the recently vacated property located at 1169 Orchard Street for future expansion purposes to its adjacent building located at 1197 Orchard and 3817 13th Street.

The respective property appears to legally consist of Lots 10 through 14, inclusive, Country Estates Subdivision, Being a Part of Northwest % of Section 32, T. 3S., R. 11E., Ecorse Township (now City of Wyandotte), Wayne County, Michigan, as recorded in Liber 32 of Plats, Page 28, Wayne County Records.

The short term benefit of selling this vacant property to Mr. Fred May is that it would enable the city to re-coup some of the costs of purchasing this property and provide some additional funds to an already strapped City budget. The long term benefit is that it would provide a steady source of income to the City and County in the form of property taxes whereas no income would be generated if it remained under City ownership.

In 1970, Mr. May moved his company' Mercury Manufacturing Company to Wyandotte. Mr. May has owned and operated Mercury Manufacturing Company since its founding in River Rouge back in 1964. Today, the company has grown from a small screw machine house to a diversified innovative company specializing in products manufactured for domestic and overseas customers.

As Operations Manager of Mercury Manufacturing Company, I am asking your Honorable Mayor and City Council Members to consider offering this above noted property for sale to Mr. May and will be available to discuss this property and selling price further.

I am writing to follow up on a letter I sent on March 26, 2007 and the resulting resolution adopted by City Council dated April 17, 2007. What I specifically requested in my March 26, 2007 letter was a copy of the resolution or ordinance that prohibits fishing at Perry Place. The April 17 resolution states that communication from the Department of Legal Affairs, City Engineer, and Superintendent of Recreation, dated April 10, 2007 was received and is on file by City Council. The Legal Affairs letter simply states that City Council has authority to control public property in the city through resolution or ordinance. However, they do not specifically cite any specific resolution or ordinance which prohibits fishing at Perry Place.

I am not challenging the City Council's authority to restrict access on public property for safety concerns. However, I have not seen the official city document which prohibits fishing at this location. Therefore, I am once again requesting a copy of the resolution or ordinance which prohibits fishing at Perry Place.

Dear Mayor DeSana and Council members,

The quality of life in a community directly reflects the effectiveness of its elected officials in fulfilling their constituents’ needs and aspirations. In this regard, may Wyandotte's dedicated and competent elected officials have the desire and means necessary to reopen Memorial Pool for our community's needs. Here are some points to ponder and benefits to be regained:

1. A functional memorial honoring all those in the military services of our country.

2. A facility reflecting the vision of the late Benjamin Yack, Superintendent of Recreation.

3. A pool for children to learn survival skills and exercise.

4. Programs for the handicapped and elderly to improve the quality of their lives (It had also proven to be a lifesaver)

5. Our site for the Downriver Senior Olympics swimming competition when we are the host city.

6. Tangible proof of Wyandotte's vitality that would help motivate families and businesses to relocate here.

7. A multi-purpose public facility that has a banquet or game room, an excellent exercise equipment room, a jacuzzi, a sauna and a sun deck.

8. Showers and locker rooms that are available to players using the connected gym and the adjacent park.

9. Adequate free parking for the many activities available at the site.

10. In 1992, the city received a $638,000 grant to upgrade Memorial Pool and it was successfully accomplished. * A new grant application and/or other funding options should be explored, based on the many benefits just enumerated.

Footnote: As a retired World War II veteran and construction engineer, I offered my services (in about 1955) to the contractor to engineer the construction of our Memorial Pool but was graciously declined. After it was completed, I swam in this beautiful facility for fifty years until its closing in 2005. Over the years, countless thousands of people enjoyed its availability to meet their needs. May our progressive community be blessed with its reopening.

Dear Wyandotte Mayor and Wyandotte City Council,

I propose the following changes be considered to the Wyandotte City Code:

1. Article II. Section 22-31 – OMIT section referencing gender distinction

a. The community's state of readiness will be enhanced. Massage therapists will be better able to respond to the needs of the community.
b. Patrons value the option and convenience of choosing expertise suited to their well- being.
c. Enhances the community economically. Massage therapy has become an important, reputable resource to the nation. Wyandotte can profit from promotion of appropriate massage.
d. Massage therapists refer their patrons to other service professions, including medical doctors, when perceived necessary.

2. Implement a WRITTEN AGREEMENT TO MASSAGE to include: Signature of patron and massage therapist; agreement must state "no genitals or nipples will be massaged"; agreement must state "when patron requests massage to end, massage will end". Other considerations should not restrict, nor burden the massage
therapist thus allowing them to make decisions based on the situation. A reference to the Wyandotte Massage Authority(ies), should the patron have an unresolved concern, would be suitable.

a. Clarifies the purpose of professional massage.
b. Enhances the communication and safety of both the patron and the massage therapist.
c. Provides guidance, promotes safe massage, and also permits flexibility in the collection of personal information.

In conclusion, when patrons are given a choice, they often prefer to be massaged by the best-trained and most experienced massage therapist(s). The supply of massage therapists is of higher quality when given the opportunity to compete. I perceive the purpose of the existing code is to ensure safe and proper massage. Perhaps the above recommendations can better support that purpose.

Mayor and Council Members,

I have written this letter to you tonight to protest the letter sent by the Mayor of our City to the Planning Commission dated May 4, 2007, said letter is attached.

The letter in my opinion shows an attempt to influence a vote by the Planning Commission in favor of Tom LaFevre of Jack's Restaurant. Such a letter is not appropriate to be sent by the Mayor who is responsible for appointing the members of this Commission and could, and should be considered as a case of undue influence upon that Public Body. The Mayor in this letter references private discussions he has had in his capacity as Mayor of Wyandotte. One with a City Manager from St. Clair Shores, and the other with a member of the Board of Directors of Henry Ford Wyandotte Hospital attesting to the character of Mr. LaFevre. Mr. LaFevre is asking the Planning Commission to allow his restaurant to open with less parking on site than is required by ordinance. The Mayor references also that Jack's Restaurant will do it's best to provide adjacent parking agreements with other sources, supposedly including the use of our City boat ramp parking. Even though there is insufficient parking the Mayor speaks of future plans by Mr. LaFevre to put condos on that site also. How is the Mayor negotiating a possible condo site on property that should go out under an RFP if Council determines it is to be sold.

This letter by the Mayor tells the Planning Commission that the boat Ramp is being considered to move to the Arkema riverfront property in the south end of our City. This property is known to be possibly severely contaminated and would probably require much work to allow public usage. This property is not under the ownership of the city and should not be referenced until we own it. "Informal" discussions as the Mayor writes, have been held with the EPA and DNR about this property. How does one governmental agency ever talk to another informally? The Mayor states that he and Councilman Sutka have been part of these discussions since "April 2006" When did this City Council make the Mayor and Councilman Sutka a two man committee to have all these discussions. Was such a resolution authorizing this power to the two of them ever voted upon on the open floor? Not to my knowledge!

It is quite sad that this current City Council has abrogated their strong oversight power conferred by our Charter, to the Mayor's office, which is supposed to be subservient to this Council, and in this instance also to Councilman Sutka. The People of this City did not elect you to be servants of the Mayor! It is a total affront to all of you that the Mayor in this letter tells the Planning Commission and you, our City Council that, "lf you have any questions about what I am saying, please feel free to contact Councilman Sutka who has been involved in many of the discussions." You, our City Council are only carbon copied on this letter; a nice way to learn what is going on isn't it! Another interesting part of this letter is the reference to "informal discussions" on the Arkema site with the Port Authority.

I am aware of a meeting held in the Mayor's office with the Mayor, Joe Voszatka and Councilman Sutka along with a Port Authority representative. What was discussed? Does this Council know? Were promises made of a preferred development agreement? Anything is possible when a Council allows its power to be diminished by a Mayor and a Councilman who are pursuing an agenda of their own making. It is time that this Council reaffirms the Charter fact, that this City is a Commission directed, STRONG Council, weak Mayor government as mandated by the People.

The actions of the Mayor and Councilman Sutka should be authorized, with proper reporting demanded to this Council, or they should be STOPPED!,

The undersigned recommends the Mayor and Council adopt the enclosed resolution recommending the Secretary of State adopt a new uniform election code that allows City-wide balloting by absentee ballot for all future City, School, State and Federal elections.

Said changes would eliminate a multitude of administrative and antiquated procedures and substantially reduce election expenditures by:

Reducing election and city-wide personnel.
Reducing transportation for set-up and tear down of voting equipment.
Eliminating disruption in schools and other precinct locations.
Protecting children from strangers within schools.
Eliminating administrative procedures for ten precincts, etc.

In addition, absentee ballot applications would be mailed to all registered voters and upon their return ballots would be mailed to their registered address. Once voted, said ballots would be returned to the City Clerk's Office for tabulation on Election Day.

Current election law requires a reason to vote absentee ballot and does little to reduce expenditures and increase voter participation. Therefore, we ask your Honorable body to adopt the above recommendation and forwarded same to Governor Granholm, State Senator Basham, Representative Farrah and Ms. Terry Lynn Land, Secretary of State with a recommendation that the uniform state election laws be modified to allow all communities the opportunity to proceed with the implementation of total absentee balloting for all future elections.

Per the City Council Resolution dated April 16, 2007, the communication from the Beautification Commission relative to the restoration of the Purple Heart Statue on Superior Boulevard at Biddle Avenue was referred to the undersigned for a report back on potential funding avenues. Along with the restoration account ($10,000) being held by the City, other. City sources of funding could be derived from the Downtown Development Authority or the Special Events Fund who have previously funded statue projects through the Art Fair Committee.

Also attached is a correspondence from Jody Chansuolme, Museum Director, suggesting additional sources of funding through the Military Order of the Purple Heart. As indicated in this correspondence, this statue has historical national significance and assistance from the national organization may be likely.

Dear Mayor DeSana and City Council Members:

The undersigned have negotiated a License Agreement with Detroit Princess to dock at Bishop Park for lunch/dinner cruises on Wednesdays and other private charters. The dock space will be north of Diamond Jack's dock space.

To limit any potential parking problems the Agreement limits the Detroit Princess to 300 passengers on the boat, although the boat has a capacity of 1,900 passengers. The Agreement states, "If any event exceeds 300 passengers then alternate locations shall be used and advertised for parking. The City will assist in determining suitable locations. The Licensee may have to operate a shuttle service if parking events exceed 300 passengers." A second measure to limit parking problems is that Detroit Princess will operate on Wednesdays while Diamond Jack operates a Thursday through Sunday schedule. Other limitations are placed on Wednesday to designate specific lunch or dinner cruises so as not to conflict with most of the uses scheduled for Bishop Park.

Since the Detroit Princess will attract people to Wyandotte, the Agreement permits the distribution of brochures and coupons for Wyandotte Businesses which are coordinated and approved by the Downtown Development Authority (DDA) on board the boat. This includes space for a brochure rack and display supplied by the DDA.

This is a one (1) year Agreement for $4,000 with $300 additional for each non Wednesday trip or private charter. The Agreement has been reviewed by the City Attorney. Renewal of the Agreement will be based on the performance during 2007 season.

This is unique opportunity to bring another activity to Downtown Wyandotte and we recommend the Mayor and City Clerk be authorized to sign said Agreement.

The Purchasers, Mr. and Mrs. Fivecoat, of the Former 605 Orchard are working with their architect/builder to submit revised plans. The Engineering Department has made the Fivecoats aware of the Razmek concerns regarding the side yard setback. Mr. and Mrs. Fivecoat have indicated that they will have a minimum 8 foot side yard setback on the east side of the proposed home. Once, a revised plan is submitted to the Engineering Department, it will be forwarded to the City Council for review and approval along with an Amendment to the Purchase Agreement.

Further, the Fivecoats have indicated that they are hoping to start construction this summer.

Dear Mayor and Council,

In accordance with a Council resolution adopted on April 16, 2007, and the Obsolete Property Rehabilitation Act, a public hearing has been scheduled on May 14, 2007, to consider establishing an Obsolete Property Rehabilitation District for the property at 1 St. Johns Street. The applicant previously submitted a written request to the Mayor and Council on April 11, 2007 (see Enclosure No. 1). Per the enclosed letter from the City Assessor (see Enclosure No. 2), the property qualifies as an obsolete property.

The Act allows for a reduction in property taxes to encourage rehabilitating obsolete commercial property. Establishing the District is the first step in the process. The next step involves filing an application for an exemption certificate that must be approved by both the Council and the State Tax Commission. The application will include detailed information on the nature and extent of the rehabilitation.

If the District is created and a certificate is eventually approved, a tax known as the Obsolete Properties Tax would be levied upon the building for 1-12 years, with the actual duration to be determined by the Council. The exemption would not apply to the taxable value of the land or any new personal property.

The undersigned recommends that the Council establish an Obsolete Property Rehabilitation District to encourage the redevelopment of the building. If you concur with this recommendation, the appropriate resolution is enclosed (Enclosure No. 3).

RESOLVED by the City Council that in order to better serve the Citizens of Wyandotte and the State of Michigan and minimize budgetary expenditures the Mayor and Council of the City of Wyandotte hereby CONCUR with the recommendation of the City Clerk of the City of Wyandotte and hereby recommends that the Secretary of State modify the uniform voting code of the State of Michigan to allow all elections to be processed (voted) by absentee ballot. AND FURTHER citing that the average Election costs the City of Wyandotte approximately $16,000 in return for a less then 10% turnout of voters in most elections. AND WEREAS all absentee voting would substantially increase voter turnout BE IT FURTHER RESOLVED that in these difficult time and in the interest of saving the City of Wyandotte and all communities in the State of Michigan funds sorely needed for other expenditures the Mayor and Council hereby recommends the Secretary of State adopt a new uniform election code that allows City-wide balloting by absentee ballot for all future City, School, State and Federal Elections.

WHEREAS, on June 6, 2000, Public Act 146 of 2000, known as the Obsolete Property Rehabilitation Act (the Act), was signed into law; and

WHEREAS, as of February 16, 2006, the City of Wyandotte was a Qualified Local Governmental Unit under Section 2 (k) of the Act; and

WHEREAS, the City Council concurs with the determination of the City Assessor dated April 11, 2007, that the building at 1 St. Johns Street suffers in excess of 50% functional obsolescence and qualifies as a “functionally obsolete property” as defined in the Obsolete Property Rehabilitation Act, Act 146 of 2000, and the Brownfield Redevelopment Financing Act, Act 381 of 1996. More specifically, the building meets the following criteria:

The floor plan, heating and mechanical systems are inappropriate for the highest and best use of the property.

WHEREAS, said property complies with the definition of commercial property provided in the Addendum to said Act; and

WHEREAS, said property is obsolete property in an area characterized by obsolete commercial property; and

WHEREAS, on April 11, 2007, the applicant, Leonard P. Nadolski, on behalf of LTW Properties, L.L.C., submitted a letter requesting that the Council establish an Obsolete Property Rehabilitation District for the property at 1 St. Johns Street; and

WHEREAS, on April 16, 2007, the City Council adopted a resolution authorizing the City Clerk to complete the actions necessary for the Council to consider establishing an Obsolete Property Rehabilitation District for said property; and

WHEREAS, a public hearing notice was published not less than 10 days or more than 30 days before the date of the hearing and written notice was sent via certified mail to the owners of all real property within the proposed Obsolete Property Rehabilitation District notifying them of a public hearing to be held on May 14, 2007; and

WHEREAS, the City of Wyandotte is authorized under the provisions of PA 146 of 2000 to establish Obsolete Property Rehabilitation Districts by resolution;

NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby finds and determines that the property at 1 St. Johns Street is obsolete commercial property in an area characterized by obsolete commercial property; and

BE IT FURTHER RESOLVED, that Obsolete Property Rehabilitation District No. 8 is hereby established for the property at 1 St. Johns Street, said property more fully described as:

Lots 4 through 10 both inclusive, SUBDIVISION OF PRIVATE CLAIM 112 for the Heirs of Antoine Labadie, Deceased, as recorded in Liber 4, Page 35 of Plats, Wayne County Records. Parcel Identification No. 57-004-07-0004-000

RESOLVED by the City Council that the owners of the garage at 2924-9th Street are hereby directed to DEMOLISH the garage and remove all debris and materials associated therewith on or before August 13, 2007. BE IT FURTHER RESOLVED that if the garage is not demolished and all debris and material removed from said property by August 13, 2007, the City will DEMOLISH the garage and remove the material and all costs will be assessed against said property.
