Dear Mayor DeSana and City Council:
I am writing to follow up on the issue of "no fishing" at the
Perry Place road ending. This issue was originally brought forward
to the Mayor and City Council by the letter of a resident, which
was addressed at the June 5, 2006 City Council meeting. A
resolution (by Councilperson Fricke) was passed, referring the
issue to the City Engineer, Superintendent of Recreation, and
Chief of Police, for a review and report back to Council in one
week.
The minutes from the June 12, 2006 City Council meeting reflect
that the City Engineer (Mark A. Kowalewski), Superintendent of
Recreation (James R. Knopp), and Chief of Police (Bobbie Heck),
reported that the City Council confirmed in 1992 that "no fishing"
and "no swimming" signs be placed at this location. The Department
of Public Service confirmed that the signs are in place.
After becoming aware of this issue, I addressed a letter to Mayor
DeSana and City Council asking that they re-consider this matter.
A resolution was passed at the July 10, 2006 City Council meeting
asking the City Engineer, Superintendent of Recreation, and
Department of Legal Affairs for a review of this issue and report
back in three weeks. However, I cannot find records in City
Council meeting minutes where this resolution was addressed.
I am writing to request the outcome of the July 10, 2006
resolution regarding fishing access at Perry Place. Furthermore,
the minutes from the June 12, 2006 City Council meeting reflect
that the Council confirmed "no fishing" is allowed at this
location. However, no statute or ordinances were specifically
cited. Please provide me with the statute or ordinance that
prohibits fishing at this location.

Dear Mayor and Council,
On April 3, 2006, the Mayor and Council authorized the undersigned
to negotiate a Cooperative Agreement with the United States
Environmental Protection Agency (EPA) regarding the use of a
$300,000 grant the City received to further capitalize the City's
existing Brownfields Cleanup Revolving Loan Fund (RLF). Enclosed
is the proposed "Assistance Agreement" with the EPA (Enclosure 1).
The RLF was initially established in 2003 through the receipt of a
$1,000,000 EPA grant. The RLF allows the City to provide
no-interest or low-interest loans to conduct cleanup activities on
City-owned brownfield properties. The loan fund will "revolve"
when the City uses tax increment revenue to make loan repayments
and then makes new loans at other sites for the same authorized
purposes. The City's initial grant was depleted as a result of the
Labadie Park project and it will be 10 years or more before there
is a sufficient loan fund balance (i.e. more that $250,000) to
make another substantial loan. Please see the enclosed application
materials and the amended Work Plan for additional information
(Enclosure 2).
It should be noted that preparation and approval of the Agreement
was delayed because the project for which funds were initially
requested – the Morningside Group condominium project – was
canceled. The proposed Agreement and amended Work Plan allows
using the funds to remediate any eligible property in the City. As
with the previous grant, this grant requires a 20% match from the
City. At this time, the Consolidated Tax Increment Finance
Authority has budgeted for the $60,000 match required. If the
actual project location is outside of the TWA boundaries, a
separate funding source must be identified.
The undersigned recommends that the Mayor and Council adopt the
following resolution (Enclosure 3) approving the Assistance
Agreement and amended Work Plan and authorizing the undersigned to
sign the "Affirmation of Award" on the City's behalf.

January 12, 2004, between the City of Wyandotte and Sarnacki &

the new Police/Court Facility. This includes termination of the
Architectural Agreement to renovate the existing Police Department
and building a new Court with Sarnacki & Associates Architects,
Inc.
Also, the attached proposed Resolution will authorize the Mayor
and City Clerk to execute the First Amendment.

I am writing about the vacant lot at 1041 Eureka. It is only 42 ft
and not buildable.
My neighbors of over 25 years (Larry & Beth Howard) and I wish to
purchase said property. We have both contacted the Engineering
Department but heard nothing.
You are aware of the parking problem in our section of Eureka.
The Howards have three grown children who have a problem parking
when visiting. They ysed to use Ann Grahl’s driveway with her
permission.
I contacted the Assessor’s Office and was told the City still
owned the property.
The lot is a mess as is our alley.
We would both like to purchase this and get it cleaned up.

We are very interested in the property at 1041 Eureka. We have
lived at 1033 for 26 yrs. Our family is growing quite fast. The
parking on Eureka Rd. is just not enough and the extra space would
be fantastic. We would like to split the property with Rose, the
adjoining neighbor. We would like to make the driveway wider for
parking. We would also like to plant flowers and fence the
remaining. Both of us on each side of 1041 Eureka have been taking
care of this property and the owner for many, many years.

In accordance with previous Council Resolutions, lots greater than
fifty (50) feet are sold for new homes and lots between forty (40)
feet and fifty (50) feet are either split or sold for new homes.
The lot at 1037 Eureka is 42.45’ wide and council should review
this list to determine if it is included with the RFP for sale.
The RFP which is attached, indicates that the two (2) parcels on
Sycamore have larger minimum square footage requirements similar
to the homes across the street; the Lincoln Parcels could be sold
as three (3) separate lots at approximately 60’ x 108’ or two (2)
separate lots at 94’ x 108’ depending on the proposals received;
and the Plum Street and Orange Parcels are required to have a rap
around front porches.
As discussed at a previous Council meeting, proposal makers are
also required to list the ranking of their proposals if submitting
more than one proposal (amended pages 2 and 12).
If you concur with this RFP the attached Resolution will direct
the City Engineer to advertise for proposals.

BASF has reviewed and approved the City of Wyandotte’s request to
utilize a portion of BASF property as a lay down area and to
utilize BASF North Works to dispose of excavated soil from the New
Police Court Project. BASF requires that the City of Wyandotte
sign the two hold harmless agreements, which are attached.
If the above proposal meets with Council’s approval, the

The Department of Engineering has met with G. V. Cement
Contracting Co. in regards to extending their contract for
concrete street replacement work at various locations in the City
of Wyandotte. Vincent Vitale, President of G.V. Cement has
indicated that they can perform the 2007 Concrete Street
Replacement Program at the unit rates set forth in the contract
with the City for the 2005 Concrete Street Replacement Program,
File #4349. The conditions of the contract extension would be as
set forth in the attached Amendment to Contract. Section 1.03.09
Contract Extension of the Contract Specifications allows extension
of the Contract for an additional two (2) consecutive years when
approved by the City Council and agreed to by the Contractor. This
would be the last year that the extension would be allowed.
The work will be funded from Act 51 Major Street Fund Account
202-440-825.460 ($348,000), Act 51 Local Street Fund Account
203-440-825.460 ($2,338), and TIFA Street Fund Account
492-200.825.460 ($117,662).

Section 2 Interpretation.
Nothing in this Ordinance or in the Code hereby adopted shall be
construed to affect any suit or proceeding in any court, or any
rights acquired, or liability incurred, or any cause or causes of
action acquired or existing, under any act or ordinance hereby
repealed; nor shall any just or legal right or remedy or any
character be lost, impaired or affected by this Ordinance.
Section 3. Severability.
Severability. Should any word, sentence, phrase or any portion of
this Ordinance be held in a manner invalid by any court of
competent jurisdiction or by any state agency having authority to
do so for any reason whatsoever, such holdings shall be construed
and limited to such word, sentence, phrase or any portion of the
Ordinance held to be so invalid and shall not be construed as
affecting the validity of any of the remaining words, sentences,
phrases or portions of this Ordinance.
Section 4. Conflicting Ordinance.
Conflicting Ordinances. All prior existing ordinances adopted by
the City of Wyandotte inconsistent or in conflict with the
provisions of this Ordinance are, to the extent of such conflict
or inconsistency, hereby expressly repealed.
Section 5. Effective Date.
This Ordinance shall take effect fifteen (15) days from the date
of its passage by the Wyandotte City Council and a notice of
ordinance adoption shall be published in a newspaper generally
circulated in the City of Wyandotte within ten (10) days after
adoption. A copy of this ordinance may be inspected or obtained at
the City of Wyandotte Clerk's Office, 3131 Biddle Avenue,
Wyandotte, Michigan.
On the question, "SHALL THIS ORDINANCE NOW PASS?" the following
vote was recorded.

acknowledges receipt of the communication from the Community
Development Director dated March 29, 2007, regarding a proposed
Assistance Agreement dated March 15, 2007, and an amended Work
Plan dated November 15, 2006, for a $300,000 grant from the United
States Environmental Protection Agency's (EPA) to supplement the
City's existing Brownfield Cleanup Revolving Loan Fund program,
and hereby approves the Agreement and the amended Work Plan and
authorizes the Community Development Director to sign the
"Affirmation of Award" on the City's behalf.

RESOLVED by the City Council that Council CONCURS with the
recommendation of the City Engineer to acquire the property at
1734-4th Street in the amount of $60,000 to be appropriated from
TIFA Area Funds; and that the Department of Legal Affairs is
hereby directed to prepare the necessary documents and the Mayor,
City Clerk and City Attorney, William R. Look are hereby
authorized to sign said documents; and that the City Engineer is
directed to DEMOLISH same upon completion of the Wyandotte
Historical Commission inspection of the home as it pertains to the
preservation of Historical and Cultural items for the City of
Wyandotte.

hereby received and placed on file. AND BE IT FURTHER RESOLVED
that said announcement be send to Wyandotte Cable for advertising.

utilize a portion of BASF property as a lay down area during
construction of the New Police/Court Project; AND BE IT RESOLVED
that the City of Wyandotte will utilize BASF North Works to
dispose of excavated dirt from the New Police/Court Project; and
that the Mayor and City Clerk be authorized to execute the
necessary hold harmless agreement documents to perform said work.

Program as set forth in the Amendment to contract for this work,
and further, authorizes the Mayor and City Clerk to sign said
amendment; FURTHER the work will be funded from Act 51 Major
Street Fund Account # 202-440-825.460 ($348,000), Act 51 Local
Street Fund Account # 203-440-825.460 ($2,338) and TIFA Street
Fund Account # 492-200-825.460 ($117,662).

RESOLVED by the City Council that the Petition from Wallace
Chomer, 1303 Lee Street, Wyandotte requesting a large boulder be
place on City property between the curb and sidewalk, at the far
west end of Lee Street at 13th Street to protect the sidewalk from
more damage from heavy trucks with trailers and to protect
children at the cross walk is hereby received and placed on file.
AND BE IT FURTHER RESOLVED that Council grants said request and
hereby directs the City Engineer and City Attorney to execute the
necessary Hold Harmless and Grant of License to the City
right-of-way for placement of said boulder at owners expense. AND
FURTHER that the request to make 13th Street a one-way street
south to north from Lee to Eureka is hereby referred to the Chief
of Police and Traffic Department for a review and report back to
Council in two weeks.
