CHAPTER VII.
ADMINISTRATIVE DEPARTMENTS - APPOINTIVE OFFICERS

[ DEPARTMENT OF ENGINEERING AND BUILDING ]

Generally.

95. Section 20. The department of engineering and building shall be in charge of the city engineer who shall be a graduate civil engineer licensed to practice engineering by the State of Michigan. On the third Monday of April, 1959, and on the third Monday of April of every second year thereafter a city engineer shall be appointed to hold office for the term of two (2) years. The city engineer shall receive such compensation as the council shall determine. He shall with the consent and approval of the council appoint a sanitary inspector and such other assistants and employees as may be necessary. The compensation of such assistants and employees shall be determined by the council.

Editor's note—The above section appears as amended by a proposition submitted to the electors on April 6, 1959, dealing with the term and qualifications of the city engineer. The Charter compilation contained in the city's 1956 Code has been relied upon for the exact rewording and for the fact that the amendment was approved by the electors.

 

Accounts and records.

96. Section 21. The city engineer shall cause to be kept proper accounts and a record of the proceedings of the department and all such accounts, records and proceedings shall be public. Such records shall be the property of the city.

 

General powers and duties.

97. Section 22. The powers and duties of the city engineer, which shall be exercised and performed as herein provided, subject to the direction of the council and in accordance with the ordinances of the city, shall be as follows:

(a) He shall have and exercise within the city the like powers and duties as are conferred by law upon county surveyors, and the like effect and validity shall be given to his official acts, surveys and plats, as are given by law to the acts and surveys of county surveyors. He shall make all necessary plats, maps, surveys, diagrams and estimates, plans and specifications required by the council or officers of the city, relating to the public improvement, buildings, grounds, and streets of the city, and all plats, maps, surveys and diagrams made by him as such surveyor shall be the property of the city and shall be delivered by him to his successor in office. He shall subject to the approval of the council establish grades for all streets, alleys and other public places. He shall perform such services for the other administrative departments of the city, as the council shall direct.

(b) He shall manage and have charge of sewers, drains, parks, the collection and disposal of garbage, reduction plants and all public work, except public work under the department of municipal service, in or upon the streets, alleys, public places and parks.

(c) He shall issue all permits for buildings, removal of buildings, excavations and other structural works. He shall enforce the provisions of the building code, and shall have charge of the inspection and regulation of all plumbing and drainage; provided that nothing herein contained shall be deemed to conflict with the powers or rules of the department of health and sanitation in relation to housing and plumbing.

(d) He shall have the supervision and control of gas inspections and the construction and installation of all elevators, steam and hot water boilers, boiler furnaces, smokestacks, pressure tanks, jacketed kettles and any form of apparatus dangerous to life and property.

(e) He shall perform such other duties as are prescribed by law or this charter, or are now or hereafter may be prescribed by ordinance or resolution of the council relating to his office or department and shall make such reports as are required by the council.
