VII.
ADMINISTRATIVE DEPARTMENTS -
APPOINTIVE OFFICERS

Departments created.
76. Section 1.
There are hereby created for the purpose of
administering the affairs of the city, aside from the powers and duties of
the elective officers of the city, the following departments, to-wit:
Department of Legal Affairs, Department of Valuation and Assessment,
Department of Health and Sanitation, Department of Municipal Service,
Department of Engineering and Building, Department of Police and Fire,
Department of Public Welfare, Department of Purchases and Supplies.

77. Section 2.
In addition to the powers and duties herein
prescribed, the council may, when not inconsistent with the provisions of
this charter assign additional and different duties to the several
administrative departments of the city, prescribe additional powers and
duties of officers and employees, may assign particular officers or
employees to one or more of the departments and may require an officer or
employee to perform duties in two (2) or more departments and may make
such other rules and regulations as may be necessary or proper for the
efficient and economical conduct of the affairs of the city. The council
shall have power from time to time to create by ordinance or resolution
such departments and employments and hire and discharge such employees,
except as herein otherwise provided, as in its best judgment may be
necessary and proper to carry on the business of the city. The mayor,
subject to confirmation of the council, shall appoint such other officers
and employees as shall be required by law or the ordinances of the city.
Selection of appointive officers.
78. Section 3.
All the appointive officers of the city shall
be appointed by the
mayor subject to confirmation by the council.
Notification of appointment of
officers; time of taking office; extension of terms of office.
79. Section 4.
The city clerk, within three (3) days after
the appointment of a person to a city office, shall notify such person, in
writing, of his appointment. All appointive officers shall enter upon
their duties of office within five (5) days after their appointment. All
appointive officers, after their several terms have expired, shall
continue to hold office until their successors are appointed, qualify and
enter upon the duties of their offices.
Compensation
of appointive officers.
80. Section 5.
All the appointive officers of the city shall
receive such compensation as the council shall by ordinance prescribe,
except as herein otherwise provided.
Filling vacancies in appointive
offices.
81. Section 6.
All vacancies in appointive offices shall be
filled by the mayor, subject to confirmation by the council.
Department of legal affairs.
82. Section 7.
The department of legal affairs shall be in
charge of the city attorney who shall be a member of the bar of the State
of Michigan and an elector of the city. On the third Monday of April,
1926, and on the third Monday of April in every second year thereafter a
city attorney shall be appointed for a term of two (2) years The city
attorney, in addition to the other duties prescribed in this charter,
shall be the legal advisor of the council and of all of the officers of
the city, and shall act as the attorney for the corporation in all legal
proceedings in which the corporation is interested. He shall prosecute all
offenses against the ordinances of the city.
Department
of valuation and assessment.
83. Section 8.
The department of valuation and assessment
shall be in charge of the city assessor who shall be an elective officer
of the city and who shall be elected as in this charter provided. The city
assessor shall perform such duties in relation to assessing property and
levying taxes in the city as are prescribed by this charter. He is
hereby authorized and required to perform the same duties that supervisors
of townships under the general laws of the state are required to perform
in relation to assessing the property and levying taxes for state, county
and school purposes. He shall perform such other duties as are prescribed
by law of assessors in cities, or are now or hereafter may be prescribed
by ordinance or resolution of the council and shall make such reports as
are required by the council.
Department of health.
84. Section 9.
The department of health shall be in charge of
the commissioner of health and sanitation who shall be the health officer
of the city. On the third Monday of April, 1959, and on the third Monday
of April in every second year thereafter a commissioner of health and
sanitation shall be appointed for a term of two (2) years. He shall be a
physician, licensed by the state of Michigan to practice medicine. He
shall be the advisor of the council upon all matters affecting the health
and sanitation of the city. He shall have all the powers and authority
conferred upon boards of health or other boards or persons by the general
health laws of this state, as the same now or hereafter may exist and
insofar as such laws may be applicable to the city. He may, by and with
the consent of the council appoint all agents and employees necessary to
the preservation and protection of the life and health of the inhabitants
of the city, and necessary to the care and treatment of sick and diseased
persons who are a charge upon the city, or who are subject to public care,
as the council and the health officer shall seem proper. He shall
investigate all complaints made concerning conditions in the city
endangering health, and report the same to the council. He shall prosecute
violations, within the city, of the health laws of the state or of the
health regulations of the city. He shall perform such duties as are
prescribed by law or this charter, or are now or hereafter may be
prescribed by ordinance or resolution of the council relating to his
office or department; and shall make such reports as are required by law
or by the council.

5272 to 1875.
85. Section 10.
Editor's noteThis paragraph dealt with the city's
representation on the board of supervisors; it has been deleted as it is
totally superseded by MCL § 46.40 et seq., MSA § 5.359(1) et seq.;
previously it had been amended by the electorate on April 4, 1955 by a
vote of 3585 to 2135.
